§ 1 Scope and provider
(1) These General Terms and Conditions (GTC) apply to all orders placed via the online shop at gocuckold.com.
(2) The provider and contracting party is Judith Swartz, Όδος Τηλεμάχου 06, Λεμεσός (Limassol), Cyprus, email: info@gocuckold.com (hereinafter “we”).
(3) The offer is directed exclusively at persons of legal age (18 years and over). By placing an order, you confirm that you are of legal age.
(4) Deviating terms of the customer do not apply unless we expressly agree to their validity.
(5) A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.
§ 2 Subject matter of the contract
(1) We sell digital content, in particular e-books and PDF files (e.g. “Die Swartz Methode” and its English edition “The Swartz Method”, the workbook “Unsere Regeln”, conversation cards), which are made available for download after purchase. No physical goods are shipped.
(2) The essential characteristics of the products are set out in the respective product description. The content serves information and entertainment purposes; it does not replace medical, psychological or therapeutic advice.
§ 3 Conclusion of the contract
(1) The presentation of the products in the shop does not constitute a legally binding offer, but an invitation to place an order.
(2) You can place products in the shopping cart and enter your details during the ordering process. Before submitting, you will see all details once again and can correct input errors. By clicking the order button, you submit a binding offer to purchase the products in the shopping cart.
(3) The contract is concluded when we accept the order by sending an order confirmation by email or by making the download available to you, whichever occurs first.
(4) The language of the contract is German; for the English edition, the contract can also be concluded in English. We will send you the contract text (order details and these GTC) by email. You can also access and save the GTC on this page at any time.
§ 4 Prices and payment
(1) All prices are final prices in euros and include statutory VAT. There are no shipping costs. This also applies to the English e-book “The Swartz Method”, which is sold in euros.
(2) Payment is made using the payment methods offered during the ordering process (e.g. credit card, Apple Pay, Google Pay via Stripe, or PayPal). The amount is due upon conclusion of the contract.
§ 5 Provision of the digital content
(1) After receipt of payment, you will receive a personal download link by email and in your customer account or on the order confirmation page.
(2) For security reasons, download links are limited in time and in the number of downloads (the limit is stated in the order email). Please save the files permanently after downloading. If you have technical problems, we will be happy to help you at info@gocuckold.com.
(3) To open the files, you need a device with a common PDF reader (e.g. Adobe Acrobat Reader, Apple Preview/Books). Some files are password-protected; we will tell you the password with your order.
§ 6 Rights of use and copy protection
(1) Upon full payment, you receive a simple, non-transferable right, unlimited in time, to use the content for private purposes. You may save it on your own devices and print it for personal use, and in the case of products for couples, also use it together with your partner.
(2) In particular, it is not permitted to pass on the content in whole or in part, to sell it, to make it publicly accessible (e.g. in file-sharing networks, forums, cloud links or social networks), to edit it or to remove protective measures.
(3) The files are personalized with your name or email address (watermark). This marking serves to protect against unauthorized distribution and must not be removed. In the event of violations, we reserve the right to take legal action.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. Details, in particular on the early expiry of the right of withdrawal for digital content, can be found in our withdrawal policy.
§ 8 Warranty
(1) The statutory provisions on liability for defects and on the provision of digital products apply.
(2) If a file is faulty, incomplete or cannot be opened, please contact us at info@gocuckold.com. We will then provide you with a working file without delay.
§ 9 Liability
(1) We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, and in accordance with mandatory statutory provisions.
(2) In the case of a slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical of the contract. Otherwise, liability for slight negligence is excluded.
(3) The content provides suggestions for consensual experiences between adults. You yourself are responsible for decisions you make on this basis and for their consequences for your relationship.
§ 10 Data protection
We process your personal data only for the purpose of handling your order and in accordance with our privacy policy. We treat your order discreetly.
§ 11 Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If you have any questions or problems, simply contact us directly at info@gocuckold.com.
§ 12 Applicable law, final provisions
(1) The law of the Republic of Cyprus applies, excluding the UN Convention on Contracts for the International Sale of Goods. With respect to consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.
(2) Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
