1. Privacy at a glance

General information

The following information provides a simple overview of what happens to your personal data when you visit this website. Personal data is any data that can be used to identify you personally. Detailed information on the subject of data protection can be found in our privacy policy listed below this text.

Data collection on this website

Who is responsible for data collection on this website?

Data processing on this website is carried out by the website operator. You can find the operator’s contact details in the section “Information about the controller” in this privacy policy.

How do we collect your data?

On the one hand, your data is collected when you provide it to us. This may, for example, be data that you enter in a contact form.

Other data is collected automatically or after your consent when you visit the website by our IT systems. This is mainly technical data (e.g. internet browser, operating system or time of page access). This data is collected automatically as soon as you enter this website.

What do we use your data for?

Part of the data is collected to ensure the error-free provision of the website. Other data may be used to analyze your user behavior.

What rights do you have regarding your data?

You have the right at any time to receive information free of charge about the origin, recipient and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you can revoke this consent at any time with effect for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

You can contact us at any time about this and other questions on the subject of data protection.

Analysis tools and third-party tools

When you visit this website, your surfing behavior may be statistically analyzed. This is done mainly with so-called analysis programs.

Detailed information on these analysis programs can be found in the following privacy policy.

2. Hosting and Content Delivery Networks (CDN)

External hosting

This website is hosted by an external service provider (host). The personal data collected on this website is stored on the host’s servers. This may include, in particular, IP addresses, contact requests, meta and communication data, contract data, contact details, names, website access data and other data generated via a website.

The host is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6(1)(b) GDPR) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6(1)(f) GDPR).

Our host will only process your data to the extent necessary to fulfil its performance obligations and will follow our instructions with regard to this data.

We use the following host:

IONOS SE
Elgendorfer Str. 57
56410 Montabaur

Conclusion of a data processing agreement

To ensure data protection-compliant processing, we have concluded a data processing agreement with our host.

3. General information and mandatory information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.

When you use this website, various personal data are collected. Personal data is data that can be used to identify you personally. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.

We would like to point out that data transmission over the internet (e.g. when communicating by email) may have security gaps. Complete protection of data against access by third parties is not possible.

Information about the controller

The controller responsible for data processing on this website is:

Judith Swartz
Όδος Τηλεμάχου, 06
Λεμεσός
info [at] gocuckold . com
Tel: 00357-5456689 (no advice by telephone)

The controller is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (e.g. names, email addresses, etc.).

Storage period

Unless a more specific storage period has been stated in this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, deletion will take place after these reasons cease to apply.

Note on data transfer to the USA and other third countries

Among other things, our website includes tools from companies based in the USA or other third countries that are not secure under data protection law. If these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that no level of data protection comparable to that in the EU can be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The lawfulness of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

IF THE DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged violation. The right to lodge a complaint exists without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only take place insofar as it is technically feasible.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Information, deletion and correction

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to correction or deletion of this data. You can contact us at any time about this and other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us about this at any time. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data happened/is happening unlawfully, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data, apart from its storage, may only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.

Objection to advertising emails

The use of contact data published within the framework of the imprint obligation for sending unsolicited advertising and information material is hereby objected to. The operators of the pages expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, such as spam emails.

4. Data collection on this website

Cookies

Our websites use so-called “cookies”. Cookies are small text files and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser.

In some cases, cookies from third-party companies may also be stored on your device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for processing payment services).

Cookies have various functions. Numerous cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies are used to evaluate user behavior or to display advertising.

Cookies that are required to carry out the electronic communication process (necessary cookies), to provide certain functions you have requested (functional cookies, e.g. for the shopping cart function) or to optimize the website (e.g. cookies for measuring the web audience) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is stated. The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies has been requested, the cookies in question are stored exclusively on the basis of this consent (Art. 6(1)(a) GDPR); consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

If cookies from third-party companies or for analysis purposes are used, we will inform you about this separately within the framework of this privacy policy and, if necessary, request your consent.

Inquiries by email, telephone or fax

If you contact us by email, telephone or fax, your inquiry including all resulting personal data (name, inquiry) will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR if your inquiry is related to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of the inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested.

The data you send to us via contact requests remains with us until you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.

5. Analysis tools and advertising

IONOS WebAnalytics

This website uses the analysis services of IONOS WebAnalytics (hereinafter: IONOS). The provider is IONOS SE, Elgendorfer Straße 57, D – 56410 Montabaur. As part of the analyses with IONOS, visitor numbers and behavior (e.g. number of page views, duration of a website visit, bounce rates), visitor sources (i.e. from which page the visitor comes), visitor locations and technical data (browser and operating system versions) can be analyzed, among other things. For this purpose, IONOS stores the following data in particular:

  • Referrer (previously visited website)
  • requested web page or file
  • browser type and browser version
  • operating system used
  • device type used
  • time of access
  • IP address in anonymized form (only used to determine the location of access)

According to IONOS, data collection is completely anonymized so that it cannot be traced back to individual persons. Cookies are not stored by IONOS WebAnalytics.

The data is stored and analyzed on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the statistical analysis of user behavior in order to optimize both its website and its advertising. If corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; consent can be revoked at any time.

Further information on data collection and processing by IONOS WebAnalytics can be found in the IONOS privacy policy at the following link:

https://www.ionos.de/terms-gtc/index.php?id=6

Data processing

We have concluded a data processing agreement with IONOS. This agreement is intended to ensure that IONOS handles your personal data in compliance with data protection law.

WordPress Statistics

This website uses “WordPress Statistics” to statistically evaluate visitor access. The provider is Automattic Inc., 60 29th Street #343, San Francisco, CA 94110-4929, USA.

WordPress Statistics uses technologies that make it possible to recognize the user for the purpose of analyzing user behavior (e.g. cookies or device fingerprinting). For analysis purposes, WordPress Statistics records, among other things, log files (referrer, IP address, browser, etc.), the origin of website visitors (country, city) and which actions they have taken on the site (e.g. clicks, views, downloads). The information collected in this way about the use of this website is stored on servers in the USA. Your IP address is anonymized after processing and before storage.

This analysis tool is used on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the anonymized analysis of user behavior in order to optimize both its website and its advertising. If corresponding consent has been requested (e.g. consent to the storage of cookies), the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; consent can be revoked at any time.

6. Couples tests (Couples Check and Common Ground)

Couples Check (German: Paar-Check): The Couples Check is evaluated exclusively in your browser. Your answers are not transmitted to us and are not stored.

Common Ground (German: Unsere Schnittmenge): In this test, two people separately answer questions about preferences and desires. So that we can calculate the matches, we store the answers (yes/maybe/no per question) on our server. These are data concerning sex life within the meaning of Art. 9 GDPR. The legal basis is your explicit consent (Art. 9(2)(a) in conjunction with Art. 6(1)(a) GDPR), which you give before starting and which you can revoke at any time by not completing the test or by sending us the link at info@gocuckold.com; we will then delete the data immediately.

We do not store any name, email address or IP address. The answers are only accessible via a randomly generated link whose secret part (after the # character) is not transmitted to our server when the page is loaded. Only the matches of both people are displayed, never individual answers. All data is automatically deleted no later than 7 days after the start. To protect against misuse, a non-reversible counter based on a hash value of the IP address is stored for one hour.

7. Email course and newsletter

If you sign up for our free email course, we process your email address and, voluntarily, your first name in order to send you the course emails as well as occasional emails with tips and offers relating to The Swartz Method. The legal basis is your consent (Art. 6(1)(a) GDPR). We use the double opt-in procedure: you are only added after you have clicked the link in our confirmation email. We store the time of registration and confirmation in order to be able to prove consent.

For management and sending, we use the WordPress plugin MailPoet. The data is stored exclusively on our own web server at our host and sent via its mail server; it is not transmitted to an external newsletter service. We do not evaluate open and click rates on a personal basis.

If you have purchased “The Swartz Method” and are already a course participant, we automatically unlock the advanced part of the course (days 8–30) for you; this is part of the purchased offer (Art. 6(1)(b) GDPR). You can unsubscribe at any time via the unsubscribe link in every email or by sending a message to info@gocuckold.com. Your data will then be deleted from the mailing list or blocked, unless there are statutory retention obligations.

8. Online shop, orders and payment

Order processing

When you buy something in our shop (WooCommerce), we process the data you enter in the order form: first and last name, email address, billing address (where requested), the products purchased, prices, time of order, the payment method chosen and the payment status. We also store that you agreed to the immediate start of the provision of digital content. We need this data to perform the contract, to provide the digital content and to send you order and download emails.

The legal basis is Art. 6(1)(b) GDPR (performance of a contract) and Art. 6(1)(c) GDPR (statutory retention obligations). We keep order and invoice data for as long as commercial and tax law requires (usually up to ten years); after that it is deleted.

Delivery of the e-books (download)

After your purchase you receive a personal download link by email. To protect against unauthorized sharing, the PDF files are marked with your name, your email address and the date when you download them; some files are additionally protected with your email address as the password. We store the number of downloads and the time of each download in order to apply the download limit and detect misuse. The legal basis is Art. 6(1)(b) GDPR and our legitimate interest in protecting our works (Art. 6(1)(f) GDPR).

If you buy Common Ground Plus, we generate an access code that is linked to your order. The answers in the test itself are not linked to your order or your name (see section 6).

Payment service providers

We use external payment service providers for payments. The data required for the payment (e.g. name, email address, invoice amount, order number and your payment details) is transmitted directly to the respective provider. We do not receive your full card details or bank login details. The legal basis is Art. 6(1)(b) GDPR; where the providers carry out fraud or credit checks, additionally Art. 6(1)(f) GDPR. Some of the processing is carried out by the providers under their own responsibility and according to their own privacy policies.

For technical reasons, your IP address and information such as browser, operating system, page visited, referring page and time are transmitted to and processed by Automattic, including in the USA.

The legal basis is our legitimate interest in a fast, stable website and simple audience measurement (Art. 6(1)(f) GDPR). Automattic is certified under the EU-US Data Privacy Framework; standard contractual clauses also apply. More information: automattic.com/privacy.
